Article 2 – Applicability
- These general terms and conditions apply to every offer from De Truffeltuin and to every distance contract concluded between De Truffeltuin and the consumer.
- Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, it will be indicated that the general terms and conditions can be viewed at our premises and that they will be sent free of charge to the consumer as soon as possible upon request.
- The consumer must be at least 18 years old to order products from De Truffeltuin. By placing an order, the consumer confirms that he/she is 18 years or older.
- Deviation from these terms and conditions is only possible if expressly agreed upon in writing.
Article 3 – The offer
- Each offer contains such information that it is clear to the consumer what the rights and obligations are that are associated with the acceptance of the offer.
- Obvious mistakes or errors in the offer do not bind De Truffeltuin.
- All images and product descriptions are indicative and may differ from the actual product.
- All prices include VAT. Any shipping costs will be stated separately during the ordering process.
Article 4 – The Agreement
- The agreement is concluded at the moment of acceptance by the consumer of the offer and compliance with the conditions set out therein.
- De Truffeltuin will send a confirmation of receipt of the order without delay. The consumer may terminate the agreement as long as this order has not been confirmed by De Truffeltuin.
- De Truffeltuin may – within legal frameworks – verify whether the consumer is able to meet his payment obligations, as well as all those facts and factors that are relevant for responsibly entering into the distance contract.
Article 5 – Right of withdrawal
- The consumer may terminate an agreement regarding the purchase of a product during a cooling-off period of 14 days without giving reasons.
- Exception – fresh products: all fresh magic truffles (sclerotia) and other fresh/perishable products are NOT subject to the right of withdrawal due to their limited shelf life. The sale of fresh truffles is final after successful payment. This applies in accordance with Article 6:230p sub e of the Dutch Civil Code.
- During the cooling-off period, the consumer shall handle the product and packaging with care. The consumer shall only unpack or use the product to the extent necessary to determine the nature, characteristics, and functioning of the product.
- To exercise the right of withdrawal, the consumer notifies us within the cooling-off period via email: info@detruffeltuin.nl
- The consumer bears the costs of returning the products.
- The refund will be processed within 14 days of receipt of the returned product.
Article 6 – Age verification and responsible use
- The products of De Truffeltuin are intended exclusively for persons 18 years of age and older.
- By placing an order, the consumer declares to be of legal age.
- De Truffeltuin reserves the right to refuse orders if there is doubt regarding the age of the person placing the order.
- The consumer is personally responsible for the use of the products. De Truffeltuin advises always starting with a low dose, not combining the products with alcohol or other substances, and using the products exclusively in a safe environment with a sober supervisor.
- The use of magic truffles is contraindicated during pregnancy, mental disorders, cardiovascular disease, and when using certain medications (such as antidepressants). Always consult a doctor if in doubt.
Article 7 – Legality and export provisions
- Magic truffles (psilocybin sclerotia) are legal in the Netherlands and are not covered by the Opium Act.
- The consumer is responsible for checking the laws and regulations in his/her country when ordering from abroad. De Truffeltuin operates exclusively in accordance with Dutch laws and regulations.
- De Truffeltuin is not liable for seized or withheld orders outside the Netherlands.
Article 8 – Delivery and execution
- De Truffeltuin will execute accepted orders with due speed but no later than within 5 working days, unless a different delivery period has been agreed.
- If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be notified of this no later than 5 working days after placing the order.
- De Truffeltuin provides discreet packaging and shipping. The contents of the package and the webshop from which it originates are not visible on the package.
- The risk of damage and/or loss of products rests with De Truffeltuin until the moment of delivery to the consumer.
Article 9 – Payment
- The consumer pays the amounts due via the offered payment methods.
- The consumer has the duty to report inaccuracies in provided or stated payment details to De Truffeltuin without delay.
- In the event of non-payment, De Truffeltuin has the right to cancel the order or not to execute it.
Article 10 – Complaints Procedure
- Complaints regarding the execution of the agreement must be submitted to De Truffeltuin via info@detruffeltuin.nl in a timely, complete, and clearly described manner.
- Complaints submitted to De Truffeltuin will be answered within a period of 14 days from the date of receipt.
- If a complaint requires a foreseeably longer processing time, De Truffeltuin will respond within the 14-day period with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed response.
Article 11 – Liability
- De Truffeltuin is not liable for damage resulting from improper use of the products, or from disregarding the instructions for use and safety advice provided with the products.
- De Truffeltuin is not liable for indirect damage, consequential damage, loss of profit, or intangible damage.
- The liability of De Truffeltuin is in all cases limited to the amount paid out by the insurance, or – in the absence of coverage – to the invoice amount of the relevant order.
Article 12 – Applicable law
Agreements between De Truffeltuin and the consumer are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the district where De Truffeltuin is established, unless the law mandatorily designates another court.
Article 13 – Amendments
De Truffeltuin reserves the right to amend these general terms and conditions. The most current version can always be found at detruffeltuin.nl . In the event of substantial changes, the consumer will be informed by email.
